1. Scope of application
The present general conditions govern the contractual relations between the architect and the client.
The general terms and conditions are deemed to be accepted upon payment of the price of the service by the customer.
Any derogation from these general terms and conditions must be in writing.
2. Subject of the contract
The architect's services include advising and assisting the client in the choice of one or more houseplants and additional advices, depending on the information given by the client and his answers to questions (colours, etc.).
The architect also provides the client with a brief analysis of the proposed plant (s) based on the principles of chromotherapy.
3. Prices, terms and conditions of payment
The fixed price packages are on the website (chromoplants.ch) under services and rates.
The price does not include the supply of the plant (s).
Payment must be made in advance, before any advice is issued by the architect.
The payment methods accepted are as follows:
- Credit card;
- Paypal account.
The customer is made aware of the fact that no refund will be made, even if he decides to interrupt the order process.
4. Timeliness of response
The treatment of the client's request varies according to the scope of the desired service.
In principle, the architect will respond within seven working days.
Depending on the final choice of the client, the architect will provide a brief analysis of the proposed plant (s), based on the principles of chromotherapy, within a further seven working days.
The architect cannot be blamed for any fault if this deadline is exceeded.
5. Accountability
The architect is bound by an obligation of resources and not of result.
The Architect shall not be liable for any damage or prejudice resulting from the performance of the contract. The architect also declines all liability for any damage caused by auxiliary staff. No liability can be attributed to the architect if the recommended plant would cause any prejudice to the client, his entourage or property.
6. Protection of data
In particular, the following data must be provided by the customer:
- Mailing address;
- Telephone number;
- Email address;
- Plant storage location (room type, light, presence of other plants, etc.);
- Photos
- Allergies.
The customer is obliged to provide truthful information.
The architect cannot be held liable for any damage whatsoever if the data supplied are or appear to be false.
All personal data are treated as confidential. All information necessary for the execution of the contract will be processed electronically and may be communicated to associated companies.
The customer accepts the fact that all correspondence is transmitted to him by unencrypted e-mail, knowing that this means does not offer all the guarantees of confidentiality of the postal mail.
7. Additional services
Any additional services not included in the formulas described under ch. 3 above will be invoiced separately.
8. Cancellation
In the event of early termination of this contract, the customer is made aware that no reimbursement can be requested from the architect.
9. Applicable law and place of jurisdiction
This contract is subject to Swiss law.
Any dispute arising from this contract, whether on matters of conclusion, execution, termination or validity, shall be submitted to the competent Vaud courts of the architect's domicile.
